Refund policy

This Return and Refund Policy applies to purchases made through the official ESPIGA Pinto Estate Shop, operated by Bishop & Melo, Lda.

Many of the artworks, prints, publications and objects offered through the shop are rare, vintage, unique or limited-edition items. Returns must therefore be handled and packed with particular care.

This Policy should be read together with our Terms of Service and Shipping Policy. Nothing in this Policy excludes or limits any consumer right that cannot lawfully be excluded or limited.

1. EU/EEA CONSUMER RIGHT OF WITHDRAWAL

If you are a consumer entitled to the European Union or European Economic Area statutory right of withdrawal, you may withdraw from an eligible distance contract without giving a reason within 14 days.

For goods, the withdrawal period normally expires 14 days after the day on which you, or a third party identified by you other than the carrier, takes physical possession of the goods.

Where several goods ordered together are delivered separately, the period normally begins when you receive the last item. Other mandatory rules may apply to goods delivered in separate lots or by periodic delivery.

To meet the withdrawal deadline, it is sufficient to send your withdrawal notice before the 14-day period expires.

2. HOW TO EXERCISE THE RIGHT OF WITHDRAWAL

To withdraw from an eligible purchase, notify us by an unequivocal statement at:

Your notice should preferably include:

  • your full name;
  • your order number;
  • a description of the item or items;
  • the date on which the order was received; and
  • a clear statement that you wish to withdraw from the contract.

You may use the model withdrawal form included in our Terms of Service, but its use is not compulsory.

We may acknowledge your withdrawal and provide packing or return instructions. Our acknowledgement does not affect the date on which you validly exercised the right of withdrawal.

3. RETURNING AN ITEM AFTER WITHDRAWAL

After notifying us of your withdrawal, you must return the item without undue delay and no later than 14 days after the date on which you notified us.

Unless we agree to collect the item or expressly state otherwise, returned items must be sent to:

Please contact us before dispatching an artwork so that we can provide suitable handling and packing guidance.

Because artworks may be fragile, valuable or unusually sized, we strongly recommend:

  • using the original packaging wherever reasonably possible;
  • using an appropriately tracked shipping service;
  • obtaining adequate transport insurance;
  • retaining proof of dispatch;
  • protecting the work against moisture, crushing, bending and abrasion; and
  • using a specialist art carrier where appropriate.

Do not affix tape, labels or other materials directly to an artwork, frame, book, certificate or Estate documentation.

Items returned to a different address may be delayed or lost. We are not responsible for a return sent to an incorrect address supplied by the customer.

Not contacting us before dispatch does not, by itself, cancel a valid statutory withdrawal, but you remain responsible for returning the item safely and within the applicable period.

4. COST OF A CHANGE-OF-MIND RETURN

For a return made under the statutory right of withdrawal because you changed your mind, you bear the direct cost of returning the item unless:

  • we expressly agree to pay or arrange that cost;
  • the product page states otherwise; or
  • applicable law requires us to bear it.

Return transport for large, fragile, high-value or internationally shipped artworks can be significant. You may contact us before purchasing to request information about likely return arrangements.

You are responsible for customs declarations and procedures relating to an international return. The package should be clearly and accurately identified as returned goods.

You may be responsible for avoidable customs, storage, brokerage or handling costs caused by an inaccurate or incomplete return declaration, to the extent permitted by law.

5. CONDITION AND HANDLING OF RETURNED ITEMS

You may inspect an item to the extent reasonably necessary to establish its nature, characteristics and condition.

You are responsible for any diminished value caused by handling beyond what is reasonably necessary for that inspection.

For artworks, prints, books and other collectible objects, diminished value may result from:

  • mounting, hinging or framing;
  • trimming, cutting or folding;
  • restoration, cleaning or treatment;
  • removal or alteration of labels, inscriptions or documentation;
  • exposure to moisture, excessive light, smoke or unsuitable temperatures;
  • fingerprints, staining, scratching, bending or abrasion;
  • removal of protective interleaving without appropriate care;
  • damage caused by unsuitable repacking; or
  • any other alteration or deterioration occurring while the item is in your care.

You do not need to return an item unopened or completely untouched. However, you must handle it only to the extent reasonably necessary to inspect it.

The item should be returned with any certificate, provenance statement, Estate documentation, catalogue, accessory or other material supplied as part of the purchase.

Where an accompanying document is missing or damaged, any resulting reduction in the item’s value may be taken into account where permitted by law.

6. REFUNDS FOLLOWING WITHDRAWAL

Where you validly exercise the right of withdrawal, we will reimburse the payments received from you for the withdrawn item.

Where you paid a delivery charge, the refund will also include the cost of the least expensive standard delivery method offered for the order, where reimbursement of that charge is required by law.

We will not reimburse any additional delivery cost resulting from your choice of a more expensive or non-standard delivery method.

Reimbursement will be made without undue delay and no later than 14 days after the day on which we receive your withdrawal notice.

We may withhold reimbursement until:

  • we receive the returned goods; or
  • you provide evidence that the goods have been sent back,

whichever occurs first.

The refund will normally be made using the same payment method used for the original purchase, unless another method is expressly agreed with you. We will not charge you a fee for the reimbursement.

The time required for the refunded amount to appear in your account may depend on your bank, card issuer or payment provider.

If a returned item has diminished in value because of handling beyond what was reasonably necessary, we may deduct an amount corresponding to that diminished value where permitted by law. We will explain any such deduction.

7. ITEMS DAMAGED DURING RETURN TRANSPORT

For a change-of-mind return arranged and dispatched by you, you are responsible for packing and transporting the item with reasonable care.

If a returned item is lost or damaged because it was inadequately packed or an unsuitable return method was used, this may affect the refund to the extent permitted by law.

Where we arrange or appoint the return carrier, responsibility for the return transport will be assessed according to the arrangements communicated to you and applicable law.

This section does not apply in the same way where the item is being returned because it was delivered damaged, incorrect or non-conforming. Those cases are addressed below.

8. DAMAGED ITEMS, DELIVERY ISSUES AND INCORRECT ORDERS

Please inspect your order promptly after delivery.

Contact us as soon as reasonably possible if:

  • the item arrived damaged;
  • the external packaging was materially damaged;
  • you received the wrong item;
  • an item is missing from the order; or
  • the item materially differs from its contractual description.

Email shop@espigapinto.com and provide, where available:

  • your name and order number;
  • a description of the issue;
  • photographs of the unopened external package;
  • photographs of the shipping label;
  • photographs of the internal packaging;
  • photographs of the artwork or item; and
  • any information supplied by the carrier.

Please keep all packaging and do not return the item before receiving our instructions, unless delay would prejudice a mandatory legal right.

Prompt notification helps us investigate the matter and pursue any carrier or insurance claim. Failure to report an issue immediately does not extinguish mandatory consumer rights.

Where the item is damaged, incorrect or non-conforming, we will bear the necessary return cost where required by law.

9. NON-CONFORMING OR DEFECTIVE GOODS

Consumers benefit from mandatory legal rights where goods do not conform to the contract.

An item may lack conformity where, for example, it:

  • is not the item ordered;
  • does not correspond materially to its product description;
  • has undisclosed material damage;
  • lacks a characteristic expressly agreed before purchase; or
  • otherwise fails to meet the applicable legal requirements of conformity.

The following do not necessarily constitute a lack of conformity:

  • an age-related characteristic disclosed before purchase;
  • a characteristic reasonably consistent with the item’s age, medium and stated condition;
  • a minor difference between individual impressions of a hand-produced edition;
  • a difference caused solely by screen colour or display settings;
  • a detail expressly identified as uncertain or subject to continuing Estate research; or
  • a characteristic specifically disclosed and accepted before purchase,

subject in each case to applicable law and the particular circumstances.

Where an item lacks conformity, the available statutory remedies may include:

  • repair or appropriate conservation;
  • replacement;
  • a proportionate reduction in price; or
  • termination of the contract and refund.

The appropriate remedy depends on the circumstances and applicable law.

Because many works are unique, vintage, rare or available only in very small quantities, repair or replacement may be impossible or disproportionate. Where that is the case, we will provide another remedy required by law.

The statutory rights relating to non-conforming goods are separate from, and may continue after the expiry of, the 14-day change-of-mind withdrawal period.

10. VINTAGE CONDITION AND AGE-RELATED CHARACTERISTICS

Many works, prints, books and objects offered through the Estate Shop are vintage, pre-owned or several decades old.

Depending on the item, age-related characteristics may include:

  • toning or discolouration;
  • foxing;
  • handling marks;
  • minor creases or undulations;
  • edge wear;
  • old mounting traces;
  • pinholes;
  • fading;
  • surface deposits;
  • minor losses; or
  • wear to bindings, covers or packaging.

Material condition issues known to us are described where relevant. Minor characteristics consistent with an item’s age, medium and disclosed condition are not necessarily defects.

Condition descriptions are reasonable opinions made in context and are not scientific guarantees. You may request additional photographs or a detailed condition report before purchasing.

Nothing in this section limits your rights where the item delivered has undisclosed material damage or does not correspond to its contractual description.

11. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The statutory right of withdrawal does not apply where an exception established by applicable law applies.

This may include goods made to the customer’s specifications or clearly personalised, such as certain:

  • bespoke frames;
  • custom mounts;
  • personalised inscriptions;
  • made-to-measure display components; or
  • specially configured products.

Where an order includes both a standard artwork and a personalised framing or mounting service, the withdrawal treatment may differ between those components.

We will identify an intended withdrawal exception before you place the relevant order.

An item is not excluded from the right of withdrawal merely because it is:

  • an original artwork;
  • unique;
  • rare;
  • vintage;
  • numbered;
  • signed;
  • an artist’s proof;
  • a trial proof;
  • limited-edition;
  • out of print; or
  • sold at a reduced price.

Other statutory exceptions may apply to particular goods or services where legally relevant and properly disclosed.

12. SALE AND PROMOTIONAL ITEMS

A sale, discount or promotional price does not, by itself, remove a consumer’s statutory right of withdrawal or rights relating to non-conforming goods.

Eligible sale items may therefore be returned under the same statutory rules described in this Policy.

Any separate discretionary promotion or return benefit may be subject to additional terms disclosed with the promotion.

13. GIFT CARDS

Any return, cancellation or refund rights relating to gift cards will be governed by:

  • the terms disclosed when the gift card is purchased;
  • whether the gift card has been used;
  • the manner in which it was supplied; and
  • applicable mandatory law.

Nothing in this section excludes a statutory right that applies to the particular transaction.

14. EXCHANGES

Because many artworks and editions are unique or available in very limited quantities, we do not guarantee exchanges.

Where you wish to obtain a different available item, the usual procedure is to:

  1. return the original item in accordance with this Policy; and
  2. place a separate order for the replacement item.

A replacement item is not reserved unless we expressly confirm the reservation in writing.

Where goods are non-conforming, any right to replacement will be assessed separately under applicable consumer law.

15. RETURNS OUTSIDE THE EU/EEA

Customers outside the EU and EEA may have cancellation, return, rejection or refund rights under mandatory laws applicable in their country or place of residence.

Nothing in this Policy excludes those rights where they apply.

Where no mandatory return right applies, a change-of-mind return from outside the EU/EEA requires our prior written agreement and may be subject to conditions communicated before the return is accepted.

Unless otherwise agreed:

  • the customer bears the return cost;
  • the item must be returned safely and in its original condition;
  • tracked and adequately insured transport must be used;
  • original delivery charges are not refundable; and
  • reasonable customs, brokerage, storage or return costs may be deducted where permitted by law.

A discretionary return authorisation does not create an ongoing obligation to accept returns in other cases.

16. ORDERS CANCELLED BEFORE DISPATCH

You may ask us to cancel an order before dispatch by emailing shop@espigapinto.com.

We will endeavour to accommodate the request. However, the order may already have entered preparation, specialist packing, framing or dispatch.

If an eligible order cannot be cancelled before dispatch, any applicable statutory withdrawal right remains unaffected.

Separate rules may apply to bespoke framing, personalised goods or specially arranged services.

17. REFUND PAYMENT ISSUES

Once a refund has been issued, processing time is controlled by the relevant bank, card issuer or payment provider.

Please contact us at shop@espigapinto.com if:

  • we have confirmed that a refund was issued but it has not appeared after a reasonable processing period;
  • the refunded amount appears incorrect; or
  • you have a question about the payment method used.

Please include your order number and the date of our refund confirmation.
